Social Media Trends from the Nielsen Social Media Report 2012

Last updated 5 hours 14 minutes ago

Nielsen?s State of the Media: The Social Media Report 2012 reflects on various social media trends of 2012, as well as the potential impact they will have on the coming year. There is no denying that social media is more popular than ever with consumers, and that having a social media presence is critical for SMBs? online marketing strategies in 2013.? Here are a few highlights from the report.

Mobile Usage Is Not Slowing Down

As you might have guessed, the amount of time consumers spent on PCs and Smartphones increased between July 2011 and July 2012.? Time spent on these devices grew by 21%, while time on apps rose 120% in that same period.? While PCs still remain our primary source of Internet access, the usage of mobile Web and apps are increasing at a significant rate. Small businesses can?t afford to ignore mobile any longer, and should invest in mobile-friendly advertising and sites to reach this growing audience.?

Time Spent on Social Networks Grew 37%.

From July 2011 to July 2012, the time consumers spent on social media sites grew from 88.4B minutes to a whopping 121.1B minutes. Nielsen attributes this substantial growth in part to the rise of mobile apps, which enable us to stay connected to our favorite sites while on the go. In fact, we spent seven times more minutes on apps than on the mobile Web. Time spent on these sites means social media access is not only on the rise, but also that we are more engaged when we do visit them. For small businesses, this means being active on social media is more important than ever in order to reach consumers spending a large portion of their time there.?

Consumers Value Social Customer Service

For more and more consumers, social care, also known as social customer service, is becoming an increasingly important, and valuable social media trend for SMBs to leverage. Nielsen reports that one in three social media users prefer social care to contacting a company by phone. That means that more consumers are using social media platforms like Facebook, Twitter, and the company blog to reach out to businesses and brands in the hope of resolving a customer service issue. SMBs are not immune to this trend, and many will see an influx of customer complaints through these channels, which can impact their online reputation. As a result, it?s vital for businesses to monitor their social media pages regularly and respond to customer questions, complaints, and more as soon as possible.?

As we?ve seen throughout the year, mobile and social media continue to top consumers? online behavior. And as 2012 winds down, it?s important for small businesses to think about whether they have successfully taken advantage of some of these social media trends, and how they can incorporate them in the future. You can read the entire Nielsen social media report here.?

How do mobile and social media fit into your online marketing strategy? Let us know in the comments!

The Worst Travel Ideas Of 2012 - Business Insider

Crap products

? Dr Bronner's magic soap has "18 different uses-in-one!" from toothpaste to massage to nappy wash!

? Wearable luggage ? Jaktogo is a very ugly coat made out of plasticky pockets so you can smuggle up to 10kg extra hand luggage on to your flight ? It also comes in dress form!

? "Round the world pants" ? cities instead of days of the week ... ?70!

Pretentious and silly travel concepts ...

? Who knows what a concierge normally does, but this year they specialised. There was the "food truck concierge" at New York's Thompson Hotels; the "sleep concierge" at The Benjamin, also in NYC; the "art concierge" at the Hazelton Hotel in Toronto; and, best of all, the "horcierge", to attend to guests' horse-related needs, such as buying jodpurs, at the Stafford London Hotel.

? Giving a fancy name to something we do already and calling it a new trend is hugely popular in the travel industry ... think "wild swimming" (swimming outside), wild camping (camping not on a campsite) and this year's fave, "the inter-generational holiday" ? going on holiday with your kids, your mum, and your nan.

? Glamping became "camp-bling" (see cargocollective.com/campbling) and in New York there was "urban glamping" on the roof of the AKA Central Park hotel.

? Have you got what it takes to survive? asked the new Bear Grylls Survival Academy. "What it takes" being ?1,899 for a five-day course in the Highlands. Oh, and Bear himself won't be there. And you have to catch your own breakfast. And sleep outside.

? The 2012 award for most pretentious concept goes to BrewDog for their "craft beer cocktail speakeasy in Shoreditch". Sounds like the marketing team just googled "most-used hipster terms" and strung them together to form a new bar. It also has a "Japanese street food menu". Of course it does.
? A Hello Kitty spa for children opened in the summer in Dubai.

? Immersive experiences that let punters experience the sort of terror depicted in slasher movies were the breakthrough event of the year. From a Horror Camp Live weekend break to zombie shopping mall shootouts in Reading.

Dog-related holidays and products ...

? The fashion world may have moved on from dogs, declaring cats and a very well-dressed monkeys the animals of 2012, but in the world of travel dogs still dominated. Pampered pooches and adventurous canines were catered for with a variety of innovative services and products. Our favourite doggy development in 2012 was the dog blog phileasdogg.com, "the only UK travel site written by dogs ... for dogs". That's right, a two-year-old mongrel called Attlee Common heads a team of Rover reporters who sniff out dog-friendly holidays and places to stay. Even if you are not a dog owner we urge you to look at this site.

? Attlee would surely approve of Best Western's response to "a surge in enquiries over the past month from guests requesting something special for their dogs to eat on Christmas Day" ? the ?105 dog's dinner, a selection of matured Kobe beef, the finest filet mignon and porterhouse steak, all cooked to order and served by a dog butler (we're not sure if this is a dog dressed as a butler or a human being). It's more expensive than the priciest Christmas meal available to guests ?

? And what should a pampered pooch wear to dine on such luxury fare? Why, a cashmere coat of course, a snip at ?161, from petsinpyjamas.com, which as well as selling outrageously expensive dog-wear also has a travel section.

? More practical ? and affordable ? canine clothing comes from Equafleece. Its 2012 contribution to dog-wear is the "portable hug" for dogs scared of fireworks. The ?13 T-shirt is designed to help dogs feel supported and "therefore more able to breathe and cope with fears".

Stupid stunts ... and stupid surveys

? At the start of this year, Jurys Inn hotels offered a free night to guests with a cheesy name, such as Mr Stilton or Mrs Cheddar to celebrate National Cheese Lovers' Day, while earlier this month The Cavendish in London was choosing one guest who would be allowed to pay for their room with chocolate coins.

? As royal fever swept the travel industry, all hotels felt obliged to provide a jubilee afternoon tea, a "right royal knees up" weekend package or, in the case of Marriott hotels, a free "corgi" cocktail to any guest called Elizabeth.

? A sea of PR swept along in the royal couple's wake as they travelled the world, and any country they visited, from the Seychelles to Canada, expected the "William and Kate effect". Then last month dozens of holiday companies started pushing their "royal babymoons".

? "Boris voted Britain's favourite beach buddy" said social travel network Gogobot, while "Going on holiday more stressful than giving birth" said some "research" by Continental Tyres.

Festival flops

? A terrible summer meant most festivals were a washout but some fared worse than others. London's first Bloc music festival was shut almost immediately due to dangerous levels of overcrowding, Creamfields was called off due to flooding, while the British Biscuit Festival failed to deliver a slam dunk.

? The poshing-up of festivals reached ridiculous levels, with an Anthropologie tent at Port Eliot, and banquets delivered by a Michelin-starred chef at Wilderness. Even Reading had glamping options that included "Podpads" and "Yurtels".

Top 10 Cocktails For Any Occasion Review | A Girl Has to Eat ...

If you love experimenting with a cocktail shaker, muddler and strainer, buy spirits online and learn to prepare 10 of the best cocktails perfect for any occasion.

1. Mojito

The mojito, the national drink of Cuba and one of Ernest Hemingway?s favourites, is a winner, no matter which recipe you choose. The traditional Cuban recipe includes white sugar, white rum, mint leaves, lime, club soda, and ice. Golden rum may give the cocktail a stronger taste.

2. Cosmopolitan

The Cosmo is very popular among ladies, especially since Sex and the City became a TV sensation. The cocktail is prepared with citron vodka, Cointreau, cranberry juice, lime juice, and ice.

3. Margarita

The national cocktail of Mexico is one of the most refreshing and easy-to-make drinks. The classic version is based on tequila ? you can use silver or golden tequila ? as well as orange liqueur, lemon or lime juice, syrup, and ice.

4. Apple Martini
The delicious cocktail suits any occasion, from weddings to corporate events. Apple martinis should contain at least one ingredient with an apple flavour, be it plain apple juice, puree, or liqueur. You can try mixing apple flavoured vodka, sour apple liqueur, pineapple juice, and apple juice.

5. Caipirinha

The basic ingredient is Cachasa but adding limes, lime juice and brown sugar is essential for giving the cocktail a unique honey taste.

6. Mint Julep
To prepare the cocktail, you can use all the bartending elements from stirring to muddling to straining to shaking. You need bourbon, white sugar, mint leaves, bitters, club soda, lime juice and ice.

7. Bellini
The classic bellini was invented in the favourite bar of Orson Welles and Ernest Hemingway opened in 1931. It?s based on chilled champagne or sparkling wine and peach puree or juice.

8. Mimosa
The recipe is probably the easiest one. By mixing chilled sparkling wine and orange juice, you get a light drink perfect for brunch.

9. Manhattan

The cocktail contains Italian vermouth, whiskey, and dash angostura. Rye whiskey may be substituted for bourbon if you like.

10. Rum Swizzle
This rum-based cocktail is often called Bermuda?s national drink. It contains rum, angostura bitters, pineapple juice, orange juice, and sweet syrup.

Stick to classic recipes or experiment, but use only quality spirits for the cocktails. To make them really avant-garde, use ice in different shapes, sizes and flavours.

Hawaii lieutenant gov. picked to fill Senate seat

HONOLULU (AP) ? Hawaii's lieutenant governor and former head of President Obama's 2008 election effort there has been named the state's newest U.S. senator, a choice that went against the dying wish of revered longtime Sen. Daniel Inouye.

Gov. Neil Abercrombie appointed Brian Schatz to the post Wednesday, instead of Inouye choice U.S. Rep. Colleen Hanabusa.

The 40-year-old Schatz, a former state representative and onetime chairman of the state Democratic party, said his top priorities would be addressing global climate change, preserving federal funds used in Hawaii for things like defense spending and transportation, and getting federal recognition for Native Hawaiians for forming their own government, similar to many Indian tribes.

Schatz, who ran with Abercrombie for the state's top two offices in 2010, beat out Hanabusa and Esther Kiaaina, a deputy director in the state Department of Land and Natural Resources.

The three candidates were selected by state Democrats Wednesday morning from a field of 14. The candidates briefly made their cases before the state party's central committee.

"No one can fill Sen. Daniel K. Inouye's shoes, but what we want to do today is find the right person to walk in his footsteps," Schatz told the committee.

"I want to be your senator because I believe Hawaii needs seniority, and we need someone who can build it up over decades and decades. And I pledge to you, if I'm given this opportunity and obligation to serve, I will try to make this my life's work and rebuild the tenure that Hawaii so desperately needs," he said.

The White House said Schatz would fly to Washington Wednesday night with Obama, who was returning from his Hawaii Christmas vacation early as Congress considers what to do about the so-called fiscal cliff.

Schatz could be sworn in as early as Thursday, which would make him Hawaii's senior senator. Hawaii's other senator, Daniel Akaka, is retiring at the end of this Congress after 22 years.

Even before winning the 2010 general election, Abercrombie expressed faith in Schatz, saying he would put him in charge of attracting more private and federal investment in Hawaii. Other responsibilities included leading the state's clean energy efforts and Asia-Pacific relations.

"To the people of Hawaii, I can assure you this: I will give every fiber of my being to doing a good job for the state of Hawaii," Schatz told a news conference in Honolulu. "We have a long and perhaps difficult road ahead of us, but we can succeed if we work together. I understand the magnitude of this obligation and this honor, and I won't let you down."

Inouye, by far Hawaii's most influential politician and one of the most respected lawmakers in Washington after serving five decades in the Senate, died last week of respiratory complications at the age of 88. He sent Abercrombie a hand-signed letter dated the day he died, saying he would like Hanabusa to succeed him, calling it his "last wish."

Four days after eulogizing Inouye in the courtyard of the Hawaii Capitol, Abercrombie said he had to consider more than just Inouye's wishes in filling his seat.

"Of course Sen. Inouye's views and his wishes were taken into account fully, but the charge of the central committee, and by extension then myself as governor, was to act in the best interests of the party ... the state and the nation," Abercrombie said.

"The law makes explicitly clear, as do the rules of the Democratic Party, that while everyone's voice is heard and everyone's view is taken into account, nonetheless, no one and nothing is preordained."

Under state law, the successor had to come from the same party as the prior incumbent. An Abercrombie spokeswoman said the governor did not feel any political pressure from within his party to make the choice he made.

"While we are very disappointed that it was not honored, it was the governor's decision to make," Jennifer Sabas, Inouye's chief of staff, said in a statement. "We wish Brian Schatz the best of luck."

Selecting Hanabusa, 61, would have required a special election in Hawaii's 1st Congressional District. Last time that happened, Hanabusa lost to Republican Charles Djou because of a winner-take-all format that split votes between Democrats.

Abercrombie said the possibility of a special election was a factor, as well as Hanabusa's "key position" on the House Armed Services Committee. The governor said she was on her way toward establishing a senior position on that panel, and it's important for Hawaii ? with its four-member delegation ? to establish seniority in both chambers.

Schatz will serve until an election is held in 2014. He said he will run for re-election to try to keep the Senate seat until 2016 ? the end of Inouye's original term ? and would run again for Senate in 2016 if given the chance.

Hanabusa congratulated Schatz in a statement.

"Having served as chair of the Hawaii Senate Judiciary Committee when the succession law was passed, I fully respect the process and the governor's right to appoint a successor," she said.

Last week, when Abercrombie announced he would not seek the seat himself, his spokeswoman Louise Kim McCoy said Abercrombie intends to make his current post as Hawaii governor the last office of his political career.

Inouye would be "very happy" with the choice, Hawaii Democratic Party chairman Dante Carpenter said. Schatz has less experience than some older politicians in the Senate but he will be building seniority, which is "critical" to the state of Hawaii, he said.

"In the words of Sen. Dan Inouye ? invoked more than once ? seniority in the United States Congress is everything," Carpenter said.

Senate Majority Leader Harry Reid had urged Abercrombie to name Inouye's successor before the end of the year. The next Congress begins Jan. 3.

Democratic Rep. Mazie Hirono, D-Hawaii, was elected in November to succeed Akaka.

First in line to replace Schatz as lieutenant governor is Senate President Shan Tsutsui, who said he planned to discuss the prospect with his family before deciding.

NRA CEO Wayne LaPierre Still Thinks Guns Aren't the Problem

National Rifle Association CEO Wayne LaPierre went on NBC's Meet the Press to further the argument he made on Friday that was poorly received by much of the media.?"If it's crazy to call for armed officers in our schools to protect our children, then call me crazy," LaPierre told David Gregory when he was shown the recent New York Post cover. "I think the American people think it's crazy not to do it. It's the one thing that would keep people safe." LaPierre honestly thinks he is the voice of the American people.?"I said what I honestly thought and ... what hundreds of millions of people all over this country will believe will actually make a difference," he said. "The NRA, we have 11,000 police training instructors, 80,000 police families, we're 4 million members and we set down and we said what can we do will actually make a difference today to make these kids safe." LaPierre also seems confident Dianne Feinstein's assault weapons ban won't pass. He dismissed it as a?"a?phony?piece of legislation," that won't pass because it's "all built on lies that have been found out." LaPierre also dismissed any indication that he might participate in the White House panel on guns.?"If it's gun safety, I think the best person to represent the NRA is Congressman Asa Hutchinson on that," LaPierre said. (We'll hear more about Hutchinson in a minute.)?"If it's a panel that's just going to be made up of a bunch of people that for the last 20 years have been trying to destroy the Second Amendment, I'm not interested in sitting on that panel," LaPierre said. "The American people support the freedoms, NRA is not going to let people lose the Second Amendment in this country."

Watch the whole interview here. David Gregory deserves some sort of medal.

RELATED: Dianne Feinstein Wants to Ban Assault Weapons

Former Arkansas Rep. Asa Hutchinson, who is an "independent consultant"?for the NRA, said the debate shouldn't focus on guns during an appearance on CNN's State of the Union.?"I want to look for solutions for safety in schools and that's not the solution. That's the wrong debate to have if you want to talk about protecting our children," Hutchinson told Candy Crowley. Hutchinson estimated the cost of putting armed guards in schools at around $2 billion, and said the NRA could offer free voluntary training to anyone who might want to help out.?

The NRA were out in full force on Sunday. NRA President David Keene appeared on CBS'?Face the Nation?to say he doesn't support an assault weapons ban.?"We've had what Sen. Feinstein is suggesting. It was allowed to expire," Keene told Bob Schieffer.?"The FBI, the Justice Department and others who studied it said it made no difference. So if we're looking at things that are effective, let's talk about it, but first let's talk about protecting our kids." Earlier in the interview he tried to explain the difference between what Adam Lanza used and what the military regularly uses.?"These aren't military weapons," he said.?"Military weapons are fully automatic weapons and that's illegal. You don't get those. That's not what we're talking about. The impression often is Bob that that is what we're talking about but it isn't. We're talking about sporting arms," he said later.?

Sen. Chuck Schumer thinks the NRA might be shooting itself in the foot with their position in the gun control debate. Schumer appeared on Meet the Press right after LaPierre did.?"I think he's so extreme and so tone deaf that he actually helps the cause of us passing sensible gun legislation in the Congress," Schumer said.?"I just think he's turning people off, that's not where America's at, and he's actually helping us," he said later. Schumer mocked LaPierre's effort to blame everything possible besides guns for the Newtown shootings.?"Now, trying to prevent shootings in schools without talking about guns is like trying to prevent lung cancer without talking about cigarettes. He is so doctrinaire and so adamant that I believe gun owners turn against him as well."

Sen. Lindsey Graham also appeared on Meet the Press?with Schumer and he doesn't really think Congress or the government can do much of anything to stop mass murders, and so he won't be supporting any sort of gun control legislation.?"I don't know if there's anything Lindsey Graham can do in the Senate to stop mass murder from somebody that's hell bent on doing crazy things," Graham said.?"We can talk all day long, we had an armed guard in Columbine, we had an assault ban, neither one of them worked," he said. "We're talking about preventing mass murder by nontraditional criminals, people who are not traditionally criminals, who are not wired right for some reason," he said.?Graham said he would support more security in schools, but legislation is off the table. His constituents told him so. "People where I live - I've been Christmas shopping all weekend - have come up to me, 'please don't let the government take my guns away," he said. "And i'm going to stand against another assault ban because it didn't work before and it won't work in the future."

Rep. Tim Scott, the guy replacing the retiring Sen. Jim DeMint, took the diplomatic route when asking on CBS's?Face the Nation?what he thinks of the NRA's proposal to put more guns in schools. He said he wants to wait and see what the panel led by Joe Biden comes up with.?"I think the President has just established a committee to take a serious, holistic look at what we need to do as a nation to make sure that our kids are safe," Scott told host Bob Schieffer. ?"To rush to judgment, I think is a bit premature, on what we should do. I think after we have the committee's report we should take a very serious look at whatever it takes to keep our kids safe at school. We don't know what that is yet and we're just finishing the week of so many funerals - we should continue to pray for the family members." Basically, Scott wants us to wait and see and not just have a knee jerk reaction to this.?"Understanding what happened and why -- after we have those answers we'll be in a much better position to decide the path forward," he said.

Moving on to the fiscal cliff,?Republican Sen. Johnny Isakson will support tax increases for the middle class if he absolutely has to, he said on ABC's This Week.?"If we get down to the end of this year and the only choice we have is to save taxes going up on the middle class, then I would support that, but I wish we would have a comprehensive bill that dealt with spending, dealt with entitlements and dealt with taxes altogether" Isakson said. "That's really what we ought to do." Isakson wished Plan B could have gathered enough support to pass in the House, but he's also aware of his position in the Senate. And the reality that it probably would have died there.?"And the president's statement is right, no one wants taxes to go up on the middle class," Isakson said. "I don't want them to go up on anybody, but I'm not in the majority in the United States Senate and he's the president of the United States."

Unfortunately your browser does not support IFrames.

Sen. John Barrasso said he thinks the President wants to go over the fiscal cliff on Fox News Sunday. Why? Because it would help him with policy, apparently.?"When I listen to the president, I think the president is eager to go over the cliff for political purposes," Barrasso said.?"I think he sees a political victory at the bottom of the cliff," he said. "He gets all this additional tax revenue for new programs; he gets to cut the military, which Democrats have been calling for for years; and he gets to blame Republicans for it."

Sen. Joe Lieberman said Chuck Hagel might have a tough time facing the Senate if he is appointed Secretary of Defense by President Obama during an appearance on CNN's State of the Union.?"I served with Chuck Hagel, I worked with him on some things. I like him, and I respect him. I wouldn't say his votes disqualify him but if I were in the Senate and on the Armed Service Committee and he was nominated, I would have some really serious questions to ask him," Lieberman said. Lieberman is retiring on Monday, so his opinion doesn't matter much, but he thinks some in the Senate might put up a fight if Hagel is nominated.?"President Obama obviously has earned the right to nominate whoever he wants but I think this'll be a very tough confirmation process," Lieberman said. "I don't know how it would end, but there are reasonable questions to ask and that Chuck Hagel will have to answer."

Also, Grover Norquist said some stuff on ABC's?This Week.

Pakistan, Afghanistan share vision on Taliban

By Michael Georgy, Reuters

KABUL -- Pakistan is genuine about backing the nascent Afghan peace process and shares the Kabul government's goal of transforming the Taliban insurgency into a political movement, a senior Afghan government official told Reuters.

"They have told us that they share the vision contained in our roadmap which is basically to transform the Taliban from a military entity into a political entity to enable them to take part in the Afghan political process and peacefully seek power like any other political entity in Afghanistan, he said.

"This is the vision that they share."

The official, who is closely involved in reconciliation efforts, said recent face-to-face talks between senior Taliban members and Afghan officials in France were an "enormously helpful" step in building a wider environment for peace.

Until now, the Taliban and Afghan officials only made indirect contacts.

The official's remarks signaled unprecedented optimism from Afghanistan that Pakistan - long accused of backing Afghan insurgent groups - was now willing to put its weight behind reconciliation efforts, which are still in early stages and are vulnerable to factionalism.

"We are very optimistic. We believe that they are genuine in this discussion with us," said the senior government official.

The senior official cautioned, however, that in order to sustain that optimism, Pakistan would need to take further concrete steps after releasing some mid-level Afghan Taliban members from detention, who may be useful in promoting peace.

The nuclear-armed South Asian nation, a strategic U.S. ally, is seen as critical to U.S. and Afghan efforts to stabilize the country before most NATO combat troops withdraw by the end of 2014.

Warring factions
Pakistan's powerful army chief has made reconciling warring factions in Afghanistan a top priority, Pakistani military officials and Western diplomats told Reuters, the clearest signal yet that Islamabad means business in promoting peace with the Taliban.

General Ashfaq Kayani, arguably the most powerful man in Pakistan, is backing dialogue partly due to fears that the end of the U.S. combat mission in Afghanistan in 2014 could energize a resilient insurgency straddling the shared frontier, according to commanders deployed in the region.

The senior Afghan government official has a similar assessment.

"I think there is a sense that we are also getting, that cooperation from Pakistan now is bound to be meaningful, substantive," he said.

"The reason is frankly, most in Pakistan, in our view, have reached the conclusion that time is running out. That it is no longer just about Afghanistan's instability and Afghanistan's insecurity but it's very much a question of security for themselves."

The Haqqani network -- which has far more experience in guerrilla warfare than the Afghan Taliban - would be welcomed to the peace process as long as it met certain conditions, said the official.

"From our point of view, the door of peace is open to anyone. The Haqqanis are a pretty challenging group of people," he said.

"But if they choose to come over to the peace process, then I am sure the peace process will include them."

Pakistan's intelligence agency denies Afghan accusations that it uses the Haqqani network and other militant groups as proxies to counter the influence of rival India in Afghanistan.

The Haqqanis are blamed for a number of high-profile attacks on Western targets, including embassies, in Kabul, highlighting the resilience of insurgents after years of fighting Western forces equipped with superior firepower and technology.

When disciplining older worker, be sure to document all examples of ...

Employees who sue for age discrimination under the Age Discrimination in Employment Act (ADEA) must prove that, if not for illegal age discrimination, their employer wouldn?t have taken an adverse employment action.

That is, a terminated employee must show that but for the former employer?s desire to discriminate against older workers, he wouldn?t have been fired. If there were other, valid reasons, the employee won?t win.

That?s why when age may be an issue, em??ployers are better off having several good reasons for terminating the employee. That makes it much harder for the employee to pin down age as the real and only reason for termination. He may be able to knock out one reason, but another may save the day.

Recent case: David was age 41 when he was fired from his job as a hospital pharmacy technician. He helped pharmacists in the control, distribution, preparation and charging of drugs.

Other duties included stocking crash carts with appropriate drugs such as anesthetics so they were always ready to be used in medical emergencies.

David found himself under the microscope when a new supervisor discovered that one of the crash carts lacked two essential drugs. She issued David an oral warning. She also said David was ?slow to complete his daily tasks as compared to other technicians and new hires.?

A few months later, David got his first written warning, this time for allegedly not stocking a dispenser with antibiotics needed for the crash carts. Ten days later, David got a second written warning, this time for allegedly losing several medications that were essential for emergency anesthesia.

Management then concluded that it was time to terminate David for his apparently careless approach to tracking and stocking drugs.

David sued, alleging he had really been fired because he was 41 years old. He pointed out that all other new hires were considerably younger and that the comment on his slow work was really proof he was being punished for being older.

In court, David claimed he might not have been responsible for the second cart incident because he hadn?t worked that particular day. Hospital representatives agreed that might have been the case. But they also argued that it wouldn?t matter. It still had two good reasons to fire David that had nothing to do with his age.

The court agreed with the hospital. It said that because David only chipped away at the underlying reasons for the first written warning, he hadn?t proved age discrimination.

Because age is the ?but for? factor, and because it was clear there were two other good reasons for termination, it follows that David could not prove age discrimination. The case was dismissed. (Grimsley v. Richardson Hospital Authority, No. 3:09-CV-2011, ND TX, 2012)

Final note: David also thought his supervisor?s comment that he worked slower than new hires was direct evidence of age discrimination just because those new hires were younger. The court rejected that argument, too.

Lizard tails detach at a biological 'dotted line'

Dec. 19, 2012 ? Like sheets of paper marked with perforated lines, gecko tails have unique structural marks that help them sever their tails to make a quick getaway. Though voluntarily shedding a body part in this manner is a well-known phenomenon, research published December 19 in the open access journal PLOS ONE reveals aspects of the process that may have applications for structural engineers making similar, quickly detachable structures.

Jan Enghild and colleagues from Aarhus University, Denmark, used advanced bio-imaging techniques to discover that a Tokay gecko sheds its tail along pre-formed "score lines" in specific regions of the tail, which is held together by adhesive forces at these lines.

The process of separation is independent of protein-cleaving enzymes, and microstructures at the ends of muscle fibers are most likely involved in the release of the tail. Enghild adds, "Our work has been driven by a curiosity to understand how tail autotomy is facilitated among lizards. In the present work we use a combination of advanced protein- and high-resolution imaging- techniques to address the mechanism involved in the process."

Fort Drum soldiers visit Oswego boy recovering from cancer

Read?more: Local, Military, News, Oswego, Cancer, Fort Drum, Army, Patty Ritchie, Military, Recovery, Young Boy, 10Th Mountain Division, Senator, Christmas, Holiday, Neuroblastoma

Julian Ross &nbsp/&nbspCourtesy: Alex Resila

OSWEGO -- Julian Ross isn't your average second grader. Like many kids his age he's fascinated with the military. However, unlike many kids, Julian has been battling stage 4 neuroblastoma for more than a year. This specific type is a common form of cancer in children.

Julian's mom, Kristi Thompson said " we are hopeful. He went from terminal cancer four months ago to no evidence of the disease today."

At his home in Oswego today, Julian got to meet his heroes. Troops came down from Fort Drum to surprise him. Walking through the rainy weather and into the front door, several members of the 10th mountain division from Fort Drum came in armed with presents. He was given an army hat which had his name on the back of it and a sweatshirt with Fort Drum in big yellow letters on the front. Most importantly Julian got the biggest Christmas present of them all. He was given the honorary title of sergeant. After the handshakes and all the salutes were finished, Julian was called by his proper name: Sergeant Ross.

One of the men who was responsible for giving these gifts was Lt. Col. Patrick Kaune. "when you see a 2nd grader like Julian who epitomizes resiliency with all that he's been through, we really wanted to come down here and help him out and recognize him and let him know that we are all pulling for him."

Although he wasn't jumping out of his chair with excitement, we can all give the little guy a break after going through all of this. State Senator Patty Ritchie arranged this early Christmas gift after learning of Julian's love of the military. One point she knows and one that we all should, is how important it is to make a child's day, especially one who deserves it like Julian. Even though Julian is too young to join the military right now, this 7-year-old could someday be the one defending our freedom.

It's unwise to start anything new today: if you do, it's likely to run out of steam very quickly. Samsung takes the top spot for 2012 cell phone shipments, Nokia 2nd, Apple 3rd

The numbers are finally starting to come out for the mobile ecosystem, even though 2012 isn't quite over yet. IHS iSuppli has released its estimations for which cell phone manufacturers shipped the most devices in 2012, and for the first time in 14 years, Samsung has taken the top spot in cell phone shipments, pushing Nokia to 2nd place, and Apple held steady in 3rd place as far as total cell phone shipments, and 2nd in the smartphone segment.According to the data, Samsung is expected to account for 29% of global cell phone shipments in 2012, with Nokia at 24%. This is almost a perfect reversal from last year when Nokia had 30% of cell phone shipments and Samsung had 24%. Impressively, Apple takes 3rd place on total cell phone shipments with 10%, even though Apple only makes smartphones, and no feature phones, unlike Samsung and Nokia.?

On the smartphone side of things, Samsung retains the top spot with 28% of global smartphone shipments, and that extends Samsung's lead over Apple, which held 20% of smartphone shipments. Last year, Samsung had 20% compared to Apple's 19%. The smartphone side also shows how Nokia lost its overall lead as it dropped from 16% of smartphone shipments in 2011 to just 5% in 2012. HTC and RIM also came in at 5% of smartphone shipments this year.?

The data also shows the general trends continuing to move towards smartphones.?Global smartphone shipments are expected to rise by 35.5% for 2012, while overall cell phone shipments will increase by just 1%. This push by smartphones is expected to lead to 47% of the total cell phone shipments to be smartphones, which is up from 35% in 2011.

Analysis: Boehner opens door to tax hikes, shifts U.S. fiscal cliff talks

WASHINGTON (Reuters) - U.S. House of Representatives Speaker John Boehner's offer to accept a tax rate increase for the wealthiest Americans knocks down a key Republican road block to a deal resolving the year-end "fiscal cliff."

The question now boils down to price - which income levels, what rates and what's offered in return. Such major questions, still unanswered so close to the end of the year suggest, however, that no surge toward an agreement is immminent.

With just over two weeks before the fiscal cliff's $600 billion in automatic tax hikes and spending cuts are triggered, threatening a new recession, there is little time to craft a comprehensive deal that will satisfy both Democrats and Republicans.

Until the latest offer, made on Friday, Boehner had insisted on extending all of the Bush era tax rates, resisting President Obama's demand to let the marginal rates rise on income above $250,000. A rising chorus of business executives also had urged Republicans to agree to this.

Although the White House has not accepted Boehner's gambit, which media reports have said includes a $1 million tax-hike threshold, it could push negotiations away from entrenched, ideological positions.

"Boehner has now accepted the premise of higher rates. So now we're just arguing over details. I think it's a significant step," said Greg Valliere, chief political strategist at Potomac Research Group.

A framework deal spelling out tax revenue and spending cut targets to be finalized in the new year could be possible, Valliere said.

"Boehner's offer to allow tax rates to go up for taxpayers earning over $1 million fundamentally transforms fiscal cliff negotiations," added Sean West, U.S. policy analyst at Eurasia Group, a political risk consultancy.

In a note to clients, West wrote that it signals, significantly, that Boehner ultimately believes a deal to avoid the cliff is still possible.

"The political burden is now shifted back to the president, who must be willing to take on his party in order to get a deal Boehner can ultimately pass. We do not think the president will overreach: Obama will work with Boehner to get to a deal."

There are still several critical elements to a deal besides a tax rate increase on the wealthy, including Republican demands to cut spending on entitlements.

Changes to the expensive Medicare and Medicaid health care programs for the elderly and the poor could be central to any deal, which must also include an increase in the federal debt limit needed by the end of February.

DEMANDS ENTITLEMENT CUTS

Boehner conditioned his tax rate increase offer on Obama agreeing to cuts in entitlement spending.

Many Republican lawmakers want to raise the eligibility age on Medicare from 65 to 67. They also want to add more means testing to Medicare, making wealthier retirees pay more for their care.

Currently, Medicare does have some means testing, charging higher premiums for coverage of doctors visits and prescription drugs to individuals earning more than $85,000 and married couples earning more than $170,000. Only about 5 percent of recipients pay these higher premiums.

Thus far, Obama has offered only about $400 billion in 10-year entitlement savings, mostly through small adjustments in reining in health care costs - not fundamental changes such as raising eligibility ages.

And just as Boehner faces opposition in his own party to raising any tax rates, Obama faces opposition to cuts to Medicare, Medicaid and Social Security from Democrats, who pledged in election campaigns they would protect these programs.

A major bloc of congressional Democrats has already signaled they will not accept major cutbacks in Medicare as part of any fiscal cliff deal.

House Minority Leader Nancy Pelosi of California and Maryland Representative Chris Van Hollen are among the high ranking Democrats in the House who in recent days have come out forcefully defending against raising the age for eligibility for Medicare from the current 65 to 67 years of age.

"Given the level of savings that is being talked about from Medicare, you can't get it all from providers and drug makers," said Paul Heldman, an analyst at Potomac Research, which tracks Washington policy for investors.

"So Opponents of raising the eligibility age have reason to believe beneficiaries will take some sort of hit if a mega-deal is cut," he said.

If Republicans are not successful in securing entitlement program cuts in exchange for a tax-rate increase on the wealthy, they are adamant about using a debt-limit increase as leverage to overhaul Social Security and Medicare.

The U.S. Treasury expects to reach its $16.4 trillion statutory debt cap by year-end, and will exhaust its remaining borrowing capacity around mid-February, risking a potential default.

Louisiana Republican Representative John Fleming, a member of the conservative Tea Party caucus who has never voted to increase the debt ceiling, said he would support a debt limit hike if it were part of a deal to make Medicare and Social Security sustainable.

The pace of activity could pick up the coming week.

House Republicans were told to prepare for a possible weekend session next week, potentially interrupting travel plans for the long Christmas holiday weekend.

House Majority Leader Eric Cantor scheduled "possible legislation related to expiring provisions of law," a reference to the expiring tax cuts, for the end of the week, portending a weekend session. Cantor has said the House would meet through the Christmas holidays and beyond.

State to help housing societies get deemed ... - Real Estate India

??|?? December 17, 2012 ?? 08:50am ??|Contributed by manoja

PUNE: The state government on Saturday launched a special drive to issue deemed conyevance deeds to eligible cooperative housing societies. All the departments concerned and stake holders were present to clear issues.

As per the existing system, all the stake holders have to go through multiple hearings with three departments ? land records, registrar of stamps and the cooperation department. The department of housing is keen to bring down the number to one or two general hearings where all the issues related to issuing deemed conveyance can be sorted out. The state will be holding the drive until June 30, 2013 during which hearings of most housing societies will be completed, officials said.

There are 80,000 housing societies in the state of which about 20,000 have received their conveyance deeds. There are about 13,400 housing societies within the limits of Pune, Pimpri Chinchwad municipal corporations and entire Haveli tehsil. An estimated 50% of them are yet to receive their conveyance deeds for various reasons, said district deputy registrar Kiran Sonawane.

Sonawane said that every district will have a committee headed by the district collector and comprise representatives of the three departments concerned who will deal with the task of issuing deemed conveyance.

Chief minister Prithviraj Chavan had called a meeting in November and asked all district collectors, officials in land records department, district deputy registrars of cooperation department and senior officials from stamp department to work together to complete the process of issuing the pending deemed conveyance deeds, said Shrikant Pulkundwar, under-secretary, state housing department.

Officials said that the first step for this committee is to prepare a district-wise detailed database of housing societies, plots and bungalows. The status of every society seeking conveyance deed will be checked with all departments concerned, which would give the administration an idea about the number of societies, how soon deemed conveyance can be issued and also the procedure. All the queries of other departments will be answered and a final decision will be taken during one hearing before the registrar from the cooperation department. Sonawane said, ?I have already asked my assistants and other officials to conduct a detailed survey of the societies in the city as a preparation for the drive. We will come to know the exact number of societies waiting for their conveyance deed. Once all the departments conduct a joint meeting, we will get a clear idea and finish issuing deemed conveyance.?

Commenting on hurdles in securing conveyance deeds, a senior official from state housing department said, ?Builders have an eye on extra floor space index (FSI), transfer of development rights (TDR) and redevelopment of old buildings and hence delay the procedure of issuing conveyance deed. If a cooperative housing society gets additional FSI or TDR, it can be utilized as per the society?s requirements; but if a housing society is not formed, the benefits go to the builder concerned.?

Suhas Patwardhan, president of Pune district housing cooperative federation, said, ?It is a good move on part of the state government since it will speed up the lengthy process and many societies waiting for their conveyance deeds will get some relief. We will also conduct an awareness campaign among the societies about the initiative and appeal to them to participate in the drive and secure deemed conveyance deeds.?
