Inmates claim state criminal laws were voided | PoconoRecord.com

Unbeknownst to most law-abiding citizens, Pennsylvania has had no criminal laws for the past 45 years.

Shocked?

A number of inmates say it's so.

In appeals, now popular in Northampton County, state prisoners insist they have found the keys to their cells. Because of a mistake when the state's constitution was rewritten in 1968, Pennsylvania has been a lawless society, lacking any criminal code.

Though the claims have been called "gobbledygook" by one Easton public defender, and "patently without merit" by the Superior Court, they are the subject of at least four recent post-conviction relief appeals in Northampton County that are costing time and money.


Lawless state

The gist of the appeals is that when Pennsylvania last held a constitutional convention in 1967-68, it failed to put in place a "savings clause" to carry over the state's criminal laws.

As a result, they were all voided when voters ratified the changes in April 1968.

Never mind that the convention delegates, judges, lawyers and lawmakers have never noticed the need for such a clause.

Or that the Legislature has been passing or modifying laws regularly since then. Or that thousands and thousands of people have been punished for violating those supposedly nonexistent statutes ? including three men who were put to death by the state.

"So if I follow your argument," Northampton County Judge Paula Roscioli asked one inmate using the premise as the basis of his appeal in June, "then no one in Pennsylvania can be convicted of any crimes, and we should just open up the doors of all of our prisons and let everyone out?"

"Yes, ma'am, I'm afraid, although it is a delicate [proposition]," replied Eric D. Vernon, 42, who pleaded guilty in 2010 to child pornography and other charges and is serving up to 10? years at Albion State Prison in Erie County.

"By the way the law is, Pennsylvania does not have the constitutional authority as of this moment, the constitutional authority to prosecute misdemeanors and felonies," said the former west Easton man, who was unsuccessful in overturning his conviction.


Draining

But while the appeals may seem on their face absurd or even humorous, they are draining time, resources and money from all levels of a court system that could otherwise be focusing on more legitimate claims, said legal officials.

The monetary price is significant, though it is difficult to place an exact figure on, Northampton County Court Administrator James Onembo said.

Just bringing Vernon and the others to and from Albion is expensive.

Sheriff Randall Miller estimated the round trip costs at around $1,500 each time, factoring in two deputies' wages, overnight stays, meals and gas.

The prison, which is near Lake Erie, is a 370-mile, six-hour drive from the courthouse in Easton. That's just one piece of the effort required by the appeals.

Because the inmates are indigent, they are granted public defenders or court-appointed lawyers, who earn a fixed annual salary regardless of their workload.

But the cases still chew up those attorneys' time ? and that of a lot of other court employees.

For an appeal, most prisoners get one or more hearings before a judge, a courtroom appearance that also pulls in a law clerk, deputy sheriffs, court officers, a stenographer and a prosecutor.

There's the time both sides invest in legal briefs and of the judge in rendering a decision. Then there's a likely appeal to Superior Court, requiring more legal arguments and the time-consuming reproduction of the lower court's record. And after that, the possibility of further appeals.

"It adds up," Onembo said, underscoring that there is no "shortcut," given a prisoner's right to appeal. "I guess it would be considered safeguards of the system."

For Northampton County District Attorney John Morganelli, claims like the savings-clause argument is a waste of time.

Morganelli said he wishes there were provisions in place to allow judges to more easily dismiss frivolous appeals without the need for hearings or briefs.

"When a document is filed, unfortunately, the court has to respond to it. You just can't ignore it," Morganelli said. "No matter how crazy it is, generally speaking, we have to file an answer to it. So there's a cost, we have to divert our resources away from other things and respond to this nonsense."


Dismissed

The origin of the claims Vernon and the others are making are murky. But they are widespread enough that they were debated in 2007 and 2008 in a series of inmate letters to "Graterfriends," a monthly publication of the Pennsylvania Prison Society.

A template of one of the legal filings used by some of the Northampton County inmates can be found online.

The document acknowledges that releasing inmates "under these conditions, may very well be distasteful to say the least," but insists that the law nonetheless requires it.

At an appeal in August, Northampton County Judge Emil Giordano asked one Albion inmate where he got the information that prisoners were being let out because the constitution lacked a savings clause.

"Through inmates," said Christopher A. Ayala, 22, a former Bethlehem man serving five to 10 years for sexually assaulting an 11-year-old girl in 2010.

"And I guess the law of attraction," Ayala added.

"The law of attraction?" Giordano asked.

"Yes, positive thinking," Ayala said. "I don't know, it just came to me."

"Oh, OK," said Giordano, who dismissed Ayala's appeal in September, finding the constitution and the state's criminal code "validly enacted" and in his case "properly followed."

Like Vernon, Ayala has since challenged the decision in Superior Court.


Lawyers in a bind

For the court-appointed defense lawyers, such appeals leave them two options. They can research and write a "no-merit letter" to the judge in which they document their clients' claims and why they are baseless.

That sets them up to withdraw from the cases, which would leave defendants with the prospect of proceeding without a lawyer or hiring one privately.

Or the attorneys can decide simply to go through the motions of helping their clients make arguments with which they almost certainly disagree.

Susan Hutnik, a public defender assigned to Vernon's case, prepared a no-merit letter before Roscioli, though she remains his attorney in the appeal to Superior Court that he filed in September.

Hutnik said it is safe to say that there are criminal laws on the books in Pennsylvania. But she said she has nonetheless invested "significant" time investigating Vernon's allegations, including calling the Armstrong County District Attorney's Office and getting it to pull the file of the case that Vernon and others like to highlight.

A website Vernon directed her to, meanwhile, had no connection to criminal law, and was actually that of a Florida-based personal injury and medical malpractice law firm, Hutnik told Roscioli.

All of what Vernon offered had "nothing to do" with his claims, Hutnik said.

"I looked up all of the cases that he cited and reviewed them so I could explain to him why it had no merit," Hutnik said. "Honestly, the argument was so bizarre that I didn't understand what he was talking about."

Lebanon urges U.N. to condemn sovereignty violation by Israel

UNITED NATIONS (Reuters) - Lebanon has called on the U.N. Security Council to condemn violations of its airspace by Israel, which carried out raids in Syria to target what it said were Iranian missiles bound for Hezbollah militants.

Lebanon urged the 15-member council to "compel Israel to halt its violations of Lebanon's sovereignty by air, sea and land, and carry out all its obligations in accordance with resolution 1701," according to a letter obtained by Reuters on Monday.

U.N. Security Council Resolution 1701 halted the 2006 Israel-Hezbollah war in southern Lebanon, which remains a Hezbollah stronghold. Lebanon regularly accuses Israel of violating its airspace.

"The Israeli Air Force continues to violate Lebanese airspace and in the previous days intensified its circuits above Lebanon. This constitutes a disgraceful violation of (Lebanon's) sovereignty," Lebanon wrote to the Security Council.

Intelligence sources said Israel attacked Iranian-supplied missiles stored near the Syrian capital of Damascus on Friday and Sunday as they awaited transport to Hezbollah, an ally of Syrian President Bashar al-Assad.

Israel is reluctant to take sides in Syria's two-year-old civil war for fear its actions would boost Islamists who are even more hostile to it than the Assad family, which has maintained a stable standoff with the Jewish state for decades.

The Security Council has been deadlocked on how to end the conflict. Assad's close ally Russia, with the aid of China, has used its veto power to block any condemnations or attempts to sanction the Syrian government.

The United Nations says more than 70,000 people have been killed in the war, which began as peaceful protests against Assad that turned violent when his forces tried to crush the revolt. The violence has become increasingly sectarian.

Five million people have fled their homes, including 1.4 million refugees in nearby countries, the United Nations says.

MARK FERGUSON: The Real Estate Agents Authority disciplinary tribunal says the former Taranaki real estate agent should be "barred" from the industry.

A former Taranaki real estate agent should barred from the industry after falsely telling potential buyers a house had been a P lab, the Real Estate Agents Authority says.

Its disciplinary tribunal found former Inglewood agent Mark Ferguson guilty of misconduct but awarded no penalty because he was no longer an agent and was bankrupt.

The authority claimed Ferguson had committed a series of misdemeanours including using a client's testimonial on the internet and in marketing material without their knowledge.

He had also "badmouthed" a property that had previously been listed with him to prospective buyers, telling them it had been used for making drugs. The house eventually sold subject to a drug test, which revealed no trace of drug use.

Another charge alleged Ferguson removed pages of a LIM report before providing it to a potential purchaser.

He also failed to honour a promise to a vendor of a $500 travel voucher in return for her listing, and was charged with inviting parties to sign documents authorising the early release of funds without advising them of the consequences.

"The tribunal expressed the view that he never be considered as suitable for a real estate licence in the future," the authority said in its decision.

Childhood disability rate jumps 16 percent over past decade

May 5, 2013 ? More children today have a disability than a decade ago, and the greatest increase is among kids in higher-income families, according to a study to be presented Sunday, May 5, at the Pediatric Academic Societies (PAS) annual meeting in Washington, DC.

The study also found that disabilities related to physical health conditions have decreased, while disabilities due to neurodevelopmental and mental health problems have increased greatly.

"Nearly 6 million kids had a disability in 2009-2010 -- almost 1 million more than in 2001-2002," said lead author Amy J. Houtrow, MD, PhD, MPH, chief, Division of Pediatric Rehabilitation Medicine at Children's Hospital of Pittsburgh of University of Pittsburgh Medical Center and associate professor of physical medicine and rehabilitation and pediatrics at University of Pittsburgh School of Medicine.

Dr. Houtrow said previous studies have indicated that the prevalence of childhood disability is increasing. She and her colleagues wanted to look more closely at the conditions and socio-demographic factors associated with disabilities.

The researchers analyzed data from the National Health Interview Survey conducted by the Centers for Disease Control and Prevention in 2001-2002 and survey data from 2009-2010. A total of 102,468 parents of children ages 0-17 years participated in the surveys.

Parents were asked whether their child had any limitations in play or activity, received special education services, needed help with personal care, had difficulty walking without equipment, had difficulty with memory or had any other limitation.

If they answered yes to any of those questions, they were asked whether their child's limitations were due to a vision or hearing problem; asthma or breathing problem; joint, bone or muscle problem; intellectual deficit or mental retardation; emotional or behavior problems; epilepsy; learning disability; speech problems; attention-deficit/hyperactivity disorder; birth defect; injury or other developmental problem.

Researchers classified conditions into three groups: physical, neurodevelopmental/mental health and other.

Results showed that the prevalence of disability increased 16.3 percent from 2001-2002 to 2009-2010.

While neurodevelopmental and mental health-related disabilities increased, those due to physical conditions decreased. This trend was most notable among children under 6 years of age whose rate of neurodevelopmental disabilities nearly doubled over the study period from 19 cases to 36 cases per 1,000 children.

"The survey did not break out autism, but we suspect that some of the increase in neurodevelopmental disabilities is due to the rising incidence or recognition of autism spectrum disorders," Dr. Houtrow said.

The data also showed that children living in poverty experienced the highest rates of disability at both time periods but not the highest growth. The largest increase was seen among children living in households with incomes at or above 300 percent of the federal poverty level (about $66,000 a year for a family of four).

"We are worried that those living in poverty may be having problems with being diagnosed and getting services," Dr. Houtrow said.

Since the study could not pinpoint why the disability rate is increasing, more research is needed, she concluded.

(AP) ? Mere months after the 2012 election, South Carolina is a buzz of political activity with a slate of potential presidential candidates already looking ahead to the state's "first in the South" primary ? still three years away.

Vice President Joe Biden, a Democrat, and Republican Sen. Ted Cruz of Texas, a tea party favorite with national aspirations, descended on South Carolina on Friday to whip up the partisan faithful and offer a presidential campaign tease for the state. Both parties are preparing for next week's special congressional election featuring former GOP Gov. Mark Sanford and Democrat Elizabeth Colbert Busch, the sister of comedian Stephen Colbert.

"As soon as I show up in South Carolina, the Washington press corps comes out and says, 'Is Biden getting ready?'" the vice president said at an annual party dinner, insisting that he came at the request of another Democrat, South Carolina Rep. James Clyburn. "I've got to make clear: I would go anywhere Jim asked me to go."

At the Democratic confab, more than 1,000 packed a convention center ballroom for the $125-per-person dinner, where Biden laid in to House Republicans for "fighting like the devil" for a budget plan that he said slashes education, undercuts law enforcement and gets rid of Medicare.

"Where are they from? What don't they understand about this country?" Biden said, his voice rising to a roar. "What don't they understand about those decent Americans, who paid their whole lives, who built this country, who fought in wars?"

Cruz reminded Republicans at an annual state GOP dinner that less than a decade ago the party controlled the White House and Congress. He said Republicans could begin to turn the tide by regaining control of the Senate in the 2014 elections. "Things can change quickly," Cruz said.

In this conservative state that reliably votes Republican in national and statewide general elections, partisans already are getting a hefty amount of attention. Typically, South Carolina finds itself at the center of American politics for a brief time every four years during the presidential primary season, when it usually is the third state to weigh in on who should become the Democratic and Republican presidential nominees.

South Carolina's primaries have played an important role in the nominating process for both parties; the state gave Barack Obama a commanding victory in 2008 and until last year, every Republican nominee had won the state's primary since Ronald Reagan in 1980.

Years ahead of the 2016 contests, Republican and Democratic hopefuls alike already are starting to survey the landscape, court support and weigh in on local matters, with wide-open fields shaping up in both parties.

"The activists in this state are unhappy about the results of the presidential election," said Jay W. Ragley, a former executive director of the state Republican Party. "They're looking for someone who has a message which national Republicans can rally behind."

With Obama barred from seeking a third term, Democrats here also may be starting to seek their own consensus candidate.

This week, Kentucky Sen. Rand Paul, a potential 2016 candidate, endorsed Sanford, and the party announced that Paul would hold fundraisers for Republicans in the state on June 28. Last month, Maryland Gov. Martin O'Malley, talked up his record ? and heaped criticism on South Carolina Republican Gov. Nikki Haley ? during a Democratic event in Charleston, while former Pennsylvania Sen. Rick Santorum, said to be eyeing another run after losing the GOP nomination last year, campaigned for Curtis Bostic, who lost to Sanford in a Republican run-off for the open congressional seat.

Florida Sen. Marco Rubio, a potential 2016 candidate, was here months ahead of the pack, headlining the state's Silver Elephant dinner last year.

Absent thus far, former Secretary of State Hillary Rodham Clinton, who has longstanding ties to South Carolina going back to the time of her husband's presidency. The former first lady and New York senator has said she has not made any decisions about her future, but many Democrats are eager for her to step forward and campaigns urging her to run are underway.

In a sign of the hunger for Clinton, House Democratic leader Nancy Pelosi gushed over Clinton's experience during an event Thursday at the Clinton School of Public Service in Little Rock, Ark., telling an audience, "I pray that Hillary Clinton decides to run for president."

Biden and Cruz were in the spotlight Friday evening ? speaking at party events about two miles from each other.

"I'll bet they're talking about the middle class ? ooph," Biden said mockingly of Cruz's Republican event.

Cruz told the GOP gathering that Biden was in Columbia. "You know, the great thing ? you don't even need a punch line. You just say that and people laugh," he said.

The vice president headlined the state party's Jefferson-Jackson dinner and then dropped by an annual fish fry held by Clyburn. Biden, who twice unsuccessfully ran for president, hasn't ruled out running a third time in 2016. But Biden's decision about whether to run seems unavoidably overshadowed by Clinton, who many Democrats say would eclipse the vice president should she choose to run.

At the fish fry celebrating Clyburn's 20 years in Congress, it was Biden who worked a rope line five people deep, greeting supporters and working the room the way he did four years ago during his second presidential campaign, and then again later as Obama's running mate.

While careful not to upstage the president with flagrant displays of ambition, Biden has kept at least a toe planted firmly in the political world since the start of his and Obama's second term.

He schmoozed with prominent Democrats from Iowa and New Hampshire ? the first two states to hold presidential primary contests last year ? during the inaugural weekend. He's making calls for the House Democrats' campaign arm, working to recruit candidates to help his party win the House next year. And last month, he traveled to Michigan to give the keynote at a state party dinner.

Biden became the figurehead for Obama's push on gun control, appearing countless times with gun violence victims and advocates to urge his former colleagues in the Senate to act. It was unsuccessful. Yet, Biden says he's not giving up the fight; he met with law enforcement officials about the issue Thursday. The same day, while in Mexico, Obama announced that Biden would play an active role in a new partnership with Mexico to strengthen the two countries' economic ties.

Cruz, meanwhile, joined a chorus of people paying tribute to former South Carolina Sen. Jim DeMint, who was an early supporter of the freshman senator.

The Texan is new to national politics, having been in Washington just a few months after becoming the lone tea party candidate to win a Senate seat last year.

In just a few weeks on the job, the insurgent Republican ran afoul of GOP mainstays, prompted Democrats to compare his style to McCarthyism and voted against nearly everything of significance that came before him. Through it all, he made clear he intends to be a conservative standard-bearer.

All that endeared him to a segment of the party and sparked talk of presidential ambitions.

On Wednesday amid presidential buzz, Cruz issued a statement on his Facebook page: "In my short tenure, my focus has been ? and will remain ? on two things: fighting for conservative principles in the Senate and working to help elect strong conservatives to win a majority in the Senate in 2014." He added: "It is a continued source of amazement that the simple fact that I am working hard with like-minded senators to keep my promise is seen as newsworthy and cause for wild speculation."

His appearance here was only fueling the talk, though he did not address the issue head-on. DeMint, a mentor who recently stepped down to become president of the conservative Heritage Foundation, tried to tamp down the speculation. "I can assure you he's thinking about Senate business and that's about it right now," DeMint said of Cruz.

Samsung, BlackBerry devices cleared for use on US defense networks

WASHINGTON (Reuters) - The Pentagon on Thursday cleared BlackBerry and Samsung mobile devices for use on Defense Department networks, a step toward opening up the military to a wide variety of technology equipment makers while still ensuring communications security.

Lieutenant Colonel Damien Pickart, a Pentagon spokesman, said the department cleared the use of BlackBerry 10 smart phones and BlackBerry PlayBook tablets using its Enterprise Service 10 system, as well as Samsung's Android Knox.

"This is a significant step towards establishing a multi-vendor environment that supports a variety of state-of-the-art devices and operating systems," Pickart said in a statement.

The Pentagon said on Wednesday it also expected to clear Apple mobile devices using the iOS 6 system at some point in early May.

The move to open up Defense Department networks is expected to set the stage for an intensified struggle for Pentagon customers among BlackBerry devices, Apple's iPhones or iPads and units using Google's Android platform such as Samsung Electronics' phones.

The Pentagon currently has some 600,000 users of smart phones, computer tablets and other mobile devices. The department has 470,000 BlackBerry users, 41,000 Apple users and 8,700 people with Android devices. Most Apple and Android systems are in pilot or test programs.

The move to open up the networks to a broader array of mobile devices is part of a Pentagon effort to ensure the military has access to the latest communications technology without locking itself in to a particular equipment vendor.

To ensure security, mobile devices and operating systems go through a security review process approved by the Defense Information Systems Agency. Once their Security Technical Implementation Guide - or STIG - is reviewed and approved, the devices can be used on the network.

Pickart said the decision on Thursday did not result in product orders. But it will enable user groups within the Pentagon to purchase the devices most appropriate for their work as the need arises.

"We are pleased to add Blackberry 10 and the Samsung Knox version of Android to our family of mobile devices supporting the Department of Defense," he said. "We look forward to additional vendors also participating in this process."

US trade deficit falls to $38.8 billion in March

(AP) ? The U.S. trade deficit narrowed in March for a second month as the daily flow of imported crude oil dropped to the lowest level in 17 years. The deficit with China hit a three-year low.

The overall trade deficit decreased to $38.8 billion, an 11 percent drop from February's $43.6 billion, the Commerce Department reported Thursday.

Exports fell 0.9 percent to $184.3 billion as sales of machinery, autos and farm products all declined. Imports fell 2.8 percent to $223.1 billion, led by a 4.4 percent drop in foreign petroleum. Crude oil imports averaged just 7 million barrels per day, the lowest since March 1996.

A smaller trade gap can boost overall economic growth as American companies earn more from overseas sales while U.S. consumers and businesses spend less on foreign products.

For the first three months of this year, the trade deficit is running at an annual rate of $507.7 billion, 5.9 percent below last year's deficit of $539.5 billion. Economists are looking for the deficit to narrow slightly this year, in part because they expect continued gains in U.S. exports.

Analysts said the lower-than-expected deficit in March will likely give a slight boost to overall economic growth for the January-March quarter. The government's first estimate put economic growth at 2.5 percent in the first quarter but some analysts said that could be revised up to perhaps 2.7 percent because of the lower trade deficit in March.

The politically sensitive deficit with China shrank 23.6 percent in March to $17.9 billion, still far above the imbalance with any other country.

Paul Ashworth, chief U.S. economist at Capital Economics, said there was a good chance the big drop in the deficit with China would be reversed in April because much of the improvement reflected the disruption of shipments of Chinese goods to the United States over the Lunar New Year holiday in China.

The deficit with the European Union grew 13 percent in March to $9.9 billion even though U.S. exports to the region rose 14.4 percent. But for the year, U.S. exports to Europe are down 8 percent compared to the same period in 2012, reflecting the impact of a recession in the 17 European Union countries that use the euro.

The European Central Bank announced Thursday that it was cutting its benchmark interest rate to a new record low in an effort to stimulate growth in the 17 European countries that use the euro currency.

The Institute for Supply Management reported Wednesday that its index of U.S. manufacturing activity expanded at a slower pace in April, held back by weaker hiring and less company stockpiling. That raised worries that overall economic growth may slow this spring.

The manufacturing index slipped to 50.7 in April. That's down from 51.3 in March and the slowest pace this year. A reading above 50 indicates expansion. A measure of export orders in the ISM survey grew at a slower pace in April.

Exports of industrial machinery, telecommunications equipment, computers, autos and farm products such as soybeans were all down in March although sales of civilian aircraft were up.

Imports of foreign-made autos dropped by $771 million in March and imports of toys and games were down $1 billion.

The U.S. economy is being hurt this year by tax hikes and spending reductions designed to curb huge federal budget deficits.

The Federal Reserve at its meeting Wednesday stood by its aggressive efforts to stimulate the economy and reduce unemployment and held out the possibility that it is prepared to do more if growth doesn't rebound from the current soft patch which the central bank blamed in part on the government's tax increases and spending cuts to curb the deficit.

Many economists believe if the government's across the board spending cuts, known as a sequester, are not lifted, growth in the current April-June quarter and the rest of this year will come at a lackluster 2 percent or less.

The 20th to 27th of April saw another Camberwell Food & Drink Festival, and I missed almost all of it. Typical. Luckily my wife, Ana, was around, so here?s her report on the Food Fair that kicked it off:

The Festival started with a food fair on Camberwell Green where some of the best local restaurants, cafes and producers met and fed a crowd willing to spend the whole day lying in the sun ? it was such a beautiful spring day. It attracted people of all ages, who happily shopped/ queued for food and sat on the green, surrounded by food stalls, just to chat, read, listen to the music and watch the colourful balloons against the clear blue sky.

Camberwell was represented by House Cafe, No 67, Falafel and Zeret. As much as I enjoy their food, I wanted to check the guys from outside our borders. I tried a delicious Orange and Ginger Marmalade from Thurstons Preserves and some really tasty cheese from Bath Soft Cheese. There was fresh meat, fish, vegetables and bread there too; if I was planning to go home after the event, I would have done my shopping for the month there.

Then I found Braziliana Cafe and I couldn?t resist having a coxinha and a Guarana ? a fried chicken croquette and a soft drink that are very popular in Brazil, my country of origin. Later, the owner Mariana Camarotte prepared feijoada, a stew of black beans with beef and pork, in the demonstration kitchen. It was quite nice to see so many people taking an interest in Brazilian food and the live cooking session helped her to sell more portions of our most famous dish.

The idea of having a stall on the farmers market on Saturdays for each restaurant to showcase their dishes and engage with the community could work well.

There are lots more pictures of the Food Fair on the Flickr stream of Changify, an organisation aimed at helping to bring about social change at a local level. They ran an event, which I was able to attend, on the last day of the Festival. This event was to gather local opinion about food options and introduce people to some of the local amenities. The morning session had some talks, including one from the Glengall Wharf Garden, a community project in Burgess Park. Then we split into two groups to have a small taster lunch, one group at The Bear and the other (mine) at The Crooked Well, where they explained their origins and how they aim to source food locally.

My group then took a tour of some of the shops in the area, and The Secret Garden, run by Tom aka TomTom aka Monkeycat, of this parish. In the afternoon there was a further workshop, but at that point I had to leave.

It?s great to see people working to effect change, so I recommend you have a look at their website to see what it offers. If nothing else, they introduced me to the delicious crepes and galettes of Maloko, the new cafe opened in the former Paul?s Continental Olive Shop, run by some lovely and friendly guys who have a mission to provide healthy vegan food at low prices.

Facebook reports higher earnings as mobile use grows

Facebook reported higher earnings in the first three months of 2013, as the social media company focuses on catering to its growing number of mobile users.

The company's net income for the first quarter was $219 million US, or nine cents per share, up from the $205 million, or nine cents per share, Facebook made a year earlier before it went public.

Revenue for the first quarter grew to $1.46 billion US, 38 per cent higher than last year. Advertising, which makes up 85 per cent of its total revenue, brought in $1.25 billion.

Almost a third of advertising revenue came from mobile ads, as a growing number of Facebook users access the site through their smartphones.

The company reported that there are now 751 million mobile users who log in at least once per month, a 54 per cent increase from last year.

Wedbush analyst Michael Pachter said the results are likely to quiet skeptics who doubted Facebook's ability to mine its growing mobile traffic for revenue. He was particularly impressed by the 23 per cent increase in Facebook's mobile ad revenue, even though the company's overall ad revenue for the period dipped six per cent from the final three months of last year.

"Their mobile business is probably bigger than any mobile business on the planet other than the (wireless telecommunications) carriers and Google," Pachter said.

Facebook started showing mobile advertisements in early 2012.

During a conference call Wednesday, Facebook CEO Mark Zuckerberg said that engaging mobile users would be a key area moving forward.

He talked about Facebook Home, a family of apps released last month that allows Android-based phone users to view and post content from their home screens.

?It really brings your phone to life,? Zuckerberg said. ?Over the next few months, we hope to push this out more broadly.?

Zuckerberg also said that the company aims to create higher-quality ads that are more personalized and integrated with Facebook news feed content.

The company?s mobile expansion impressed Sterne Agee analyst Arvind Bhatia. "They are making the transition to mobile faster than anyone anticipated," Bhatia said. "It seems like they are delivering."

Bhatia thinks Facebook will fare even better on mobile devices once Zuckerberg firms up its plan to make money from the growing audience checking into Instagram, a photo-sharing service that the company bought last year for $521 million. The analyst believes Instagram will play a bigger role in Facebook's business next year.

Instagram now has 100 million monthly users, compared to 22 million when Facebook acquired the company last year.
