MARK FERGUSON: The Real Estate Agents Authority disciplinary tribunal says the former Taranaki real estate agent should be "barred" from the industry.

A former Taranaki real estate agent should barred from the industry after falsely telling potential buyers a house had been a P lab, the Real Estate Agents Authority says.

Its disciplinary tribunal found former Inglewood agent Mark Ferguson guilty of misconduct but awarded no penalty because he was no longer an agent and was bankrupt.

The authority claimed Ferguson had committed a series of misdemeanours including using a client's testimonial on the internet and in marketing material without their knowledge.

He had also "badmouthed" a property that had previously been listed with him to prospective buyers, telling them it had been used for making drugs. The house eventually sold subject to a drug test, which revealed no trace of drug use.

Another charge alleged Ferguson removed pages of a LIM report before providing it to a potential purchaser.

He also failed to honour a promise to a vendor of a $500 travel voucher in return for her listing, and was charged with inviting parties to sign documents authorising the early release of funds without advising them of the consequences.

"The tribunal expressed the view that he never be considered as suitable for a real estate licence in the future," the authority said in its decision.
